Terms & Conditions: Ember Entertainment

These Terms & Conditions (“Terms”) apply to all bookings, services, interactions, and website use associated with Ember Entertainment (“we”, “our”, or “us”). By making a booking or engaging with our services, you agree to these Terms.

1. Bookings & Deposits

All bookings require a deposit to secure talent.
Deposit amounts may vary and will be confirmed during the booking process.
No booking is confirmed until the deposit has been received.
Remaining balances are payable in cash directly to the performer on arrival, before the shift commences.
Bank transfer for full payment may be accepted if arranged and approved prior to the booking date.

2. Cancellations & Refunds

Refunds are offered case by case, at Ember Entertainment’s discretion.
Deposits are generally non-refundable unless Ember Entertainment cancels the booking or is unable to provide a suitable replacement.
Clients who cancel due to personal change of mind, schedule changes, or event disruptions may not be entitled to a refund.

3. Behaviour & Safety

Ember Entertainment prioritises the wellbeing and safety of our performers at all events.

3.1 Performer Safety

Aggressive, threatening, inappropriate, or unsafe behaviour towards performers will not be tolerated.
Performers reserve the right to leave immediately if they feel unsafe, disrespected, or subjected to unacceptable conduct.
If a performer leaves due to unsafe conditions, no refund will be issued.

3.2 Conduct of Guests

Clients are responsible for ensuring all guests behave appropriately throughout the booking.
Excessive intoxication, harassment, pressure to engage in activities outside the agreed service, or disrespectful behaviour may result in the immediate termination of the booking.

3.3 Vetting & Location Requirements

To ensure safety, Ember Entertainment may request additional information about the event location, attendees, or environment.
Bookings may be declined at our discretion if we consider the setting unsuitable or unsafe.

4. Filming & Privacy

Strictly no filming, photography, or recording of performers without explicit consent.
Performers may refuse or stop a booking if unauthorized filming occurs.
Ember Entertainment respects your privacy and does not publish or use client images unless formal consent is provided.

5. Payment Terms

Deposits are payable via bank transfer.
Final balances are payable in cash to the performer upon arrival unless a bank transfer is pre-approved.
Failure to pay on arrival will result in cancellation of the booking, and the deposit will be forfeited.

6. Travel & Additional Fees

Travel fees may apply depending on the booking location.
Any additional charges will be discussed and agreed upon during the booking process.

7. Service Expectations

Performers will provide the services previously agreed to during the booking.
Services cannot be altered, extended, or upgraded on the day unless approved by both the performer and Ember Entertainment.
Overtime, if requested and accepted, may incur additional costs.

8. Changes to Bookings

Requests to change the booking time, location, or service type must be made in advance.
Approval of changes is subject to performer availability.
Significant changes may require a new quote or additional fees.

9. Liability

Ember Entertainment is not liable for injuries, property damage, or incidents occurring at events or venues.
Clients are responsible for providing a safe environment and ensuring compliance with local laws.
We cannot guarantee specific outcomes or availability of particular performers.

10. Website Use & Terms

By accessing the Ember Entertainment website, you agree not to:

misuse the site,
scrape or copy content without permission,
engage in unlawful or prohibited activity,
distribute harmful or malicious files.

All website content remains the property of Ember Entertainment.

11. Amendments

Ember Entertainment may update these Terms & Conditions at any time. Changes will be posted on our website, and continued use of our services indicates acceptance of the revised Terms.
